    General Terms and Conditions for Group Travel & Incentives of eSCe Reizen, located at De Hennenkamp 2, 7021 NN, Zelhem.

    Introductory provisions

    Article 1

    In these terms and conditions, eSCe Reizen refers to the organisation eSCe Reizen, located at De Hennenkamp 2, 7021 NN, Zelhem.

    Client: the party that commissions eSCe Reizen to organise and execute a trip.

    Travel Agreement: the agreement whereby eSCe Reizen commits to its client to provide a trip organised in consultation with the client.

    Traveller: the person for whose benefit the trip has been arranged.

    Formation of the Travel Agreement

    Article 2, paragraph 1

    The agreement is concluded by oral acceptance or via email or signature of the offer from eSCe Reizen by the client. After acceptance, the client is bound by the agreement.

    Article 2, paragraph 2

    a. The offer from eSCe Reizen is non-binding and can be revoked by eSCe Reizen if necessary, even after acceptance. Revocation must occur within 2 working days after the conclusion of the agreement.

    b. Obvious errors in the offer do not bind eSCe Reizen.

    Article 2, paragraph 3

    For the purpose of concluding the travel agreement and its execution, the client will provide all necessary data concerning themselves and the other traveller(s) to eSCe Reizen in a timely manner (no later than 28 days before departure).

    Article 2, paragraph 4

    The person who enters into a travel agreement on behalf of or for the benefit of another is jointly and severally liable for all obligations arising from the agreement.

    Article 2, paragraph 5

    All data from the offer of eSCe Reizen are also part of the travel agreement, unless otherwise indicated. Any requested deviation from or addition to the travel arrangement offered by eSCe Reizen requires the express written confirmation of eSCe Reizen.

    Article 2, paragraph 6

    eSCe Reizen bears no responsibility for photos, brochures, and other informational material issued under the responsibility of third parties.

    Payment

    Article 3, paragraph 1

    Upon conclusion of the travel agreement, a sum (down payment) equal to 20% of the total agreed travel sum, and at least € 150,- per traveller, must be paid within 8 days, unless otherwise specified in the relevant offer. Furthermore, for airline tickets that must be issued within 12 to 72 hours of booking, a higher down payment may be charged. Booked airline tickets and scheduled service tickets are always non-refundable.

    Article 3, paragraph 2

    The remainder of the travel sum must be in the possession of eSCe Reizen no later than 8 weeks before departure. In case of late payment, after a reminder and the expiry of the term set in the reminder, the travel agreement can be terminated with immediate effect by or on behalf of eSCe Reizen, in which case Article 7 applies, and the amounts already paid will be offset against the cancellation fees or compensation. If the travel agreement is concluded within 8 weeks before the day of departure, the entire travel sum must be paid immediately.

    Article 3, paragraph 3

    Deliveries and services not included in the original travel agreement but commissioned during the trip will be invoiced to the client immediately after the execution of the agreement.

    Article 3, paragraph 4

    eSCe Reizen will charge administration fees of € 27.50 for each invoice.

    Travel Sum

    Article 4, paragraph 1

    The travel sum is per person, unless otherwise indicated in the offer. If the number of persons deviates from that indicated in the offer, eSCe Reizen is entitled to set a new travel sum.

    Article 4, paragraph 2

    The travel sum is based on prices, including transport and fuel costs, exchange rates, levies, and taxes, etc., as known to eSCe Reizen at the time of providing the offer.

    Article 4, paragraph 3

    eSCe Reizen reserves the right to increase the travel sum if, after the conclusion of the travel agreement, increases occur in the cost components as referred to in paragraph 2.

    Article 4, paragraph 4

    The agreed travel sum will no longer be adjusted to the number of participants for extra bookings from 4 weeks before departure.

    Information

    Article 5, paragraph 1

    The client and the travellers must be in possession of a valid travel document at departure and during the trip. Depending on the type of trip, additional documents such as visas, proof of vaccinations, driving licenses, and insurance papers may be required.

    Article 5, paragraph 2

    The client will obtain the necessary information from the relevant authorities themselves and will also check in a timely manner before departure whether the previously obtained information has not changed in the meantime.

    Article 5, paragraph 3

    If the client or the traveller(s) cannot make the trip (in full) due to the lack of any (valid) document, this, with all associated consequences, will be for the account of the client, unless eSCe Reizen has agreed in writing to arrange for that document.

    Substitution

    Article 6

    The traveller may be replaced by another person in a timely manner before the start of the trip. The following conditions apply:

    a. the other person meets all conditions associated with the agreement;

    b. the request is submitted no later than 7 days before departure, or in such time that the necessary actions and formalities can still be carried out;

    c. the conditions of the service providers involved in the execution do not oppose this substitution;

    d. Amendment costs are for the account of the client. The original registrant and the person replacing them are jointly and severally liable to eSCe Reizen for the payment of the remaining part of the travel sum, and any additional costs resulting from the substitution.

    Cancellation by the Client

    Article 7, paragraph 1

    If a travel agreement is cancelled in whole or in part by the client, the client owes eSCe Reizen the following cancellation fees:

    a. For cancellation up to the 28th day before departure: 50% of the travel sum;

    b. For cancellation from the 28th day (inclusive) up to the 8th day before departure: 75% of the travel sum;

    c. For cancellation from the 8th day (inclusive) up to the day of departure: 90% of the travel sum;

    d. For cancellation on the day of departure or later: 100% of the travel sum.

    Article 7, paragraph 2

    For air travel, the general terms and conditions of the respective airline apply in combination with the general terms and conditions of eSCe Reizen for the other travel components.

    Article 7, paragraph 3

    If one or more travellers belonging to the same group cancel, the percentages as stated in Article 7, paragraphs 1 and 2, multiplied by the travel sum per person and also multiplied by the number of travellers who have cancelled, apply.

    Termination by eSCe Reizen

    Article 8

    eSCe Reizen has the right to terminate the travel agreement with immediate effect and without judicial intervention, before or during the trip, if circumstances arise that prevent the undisturbed execution of the travel agreement from being guaranteed. After termination, the already paid travel sum will be refunded to the client within 2 weeks, however, reduced by the costs that eSCe Reizen has had to incur and is obliged to pay to third parties.

    Modification by eSCe Reizen

    Article 9

    If the service providers engaged by eSCe Reizen for the execution of the trip are not able, or not able in time, to provide the agreed services, eSCe Reizen has the right to modify the travel agreement before or during the trip. If (part of) the services cannot be provided, eSCe Reizen will endeavor to make appropriate alternative arrangements with a view to continuing the trip.

    Liability of eSCe Reizen

    Article 10, paragraph 1

    eSCe Reizen is not liable for the non-performance or improper performance of the travel agreement, insofar as the shortcomings are not attributable to its fault, nor are they for its account under Dutch law or generally accepted standards in the Netherlands.

    Article 10, paragraph 2

    eSCe Reizen is not liable for damage resulting from the improper execution of the travel agreement, if and insofar as the shortcomings in the execution are attributable to the client or the travellers involved.

    Article 10, paragraph 3

    When eSCe Reizen is liable for the damage suffered by the client or travellers, its liability will be limited or excluded in accordance with the applicable statutory provisions or international treaties. All other damages for which eSCe Reizen could be held liable are limited to a maximum of once the travel sum per person.

    Obligations of the Client / Traveller

    Article 11, paragraph 1

    The client(s) and the travellers involved are obliged to comply with all instructions from eSCe Reizen to promote the proper execution of the trip and are liable for damage caused by their unauthorized conduct.

    Article 11, paragraph 2

    A client or traveller who causes or may cause such nuisance or inconvenience that the proper execution of a trip is or could be severely hampered, can be excluded from (continuation of) the trip by eSCe Reizen.

    Interest and collection costs

    Article 12

    If monetary obligations to eSCe Reizen are not met on time, an interest of 1% is due on the principal sum for each month or part of a month of delay. Furthermore, the client is then obliged to compensate for extrajudicial collection costs equal to 15% of the amount claimed, plus € 34.50 in costs, with a minimum total of € 45,-.

    Force Majeure

    Article 13

    In the event of force majeure, eSCe Reizen has the right to dissolve the travel agreement in whole or in part without notice and/or default and without judicial intervention, without eSCe Reizen being liable for any compensation.

    Complaints

    Article 14

    The client must report complaints directly to the service provider and must first try to reach a solution on the spot. If the complaint cannot be resolved on the spot, the client must immediately contact eSCe Reizen. If the complaint cannot be resolved satisfactorily on the spot, it must be submitted in writing and with justification to eSCe Reizen as soon as possible, but no later than 1 month after return.

    General provisions

    Article 15

    eSCe Reizen and the client expressly agree that no other general or special conditions than the present ones apply to the concluded travel agreement. All disputes that may arise in connection with the travel agreement will be submitted to a competent court, insofar as the law permits, and furthermore, Dutch law will apply to the travel agreement.
